Agorart is an e-shop created by two friends with a love for handmade creations! Agorart collaborates with creators from all over Greece to bring their products to the doorstep of everyone who loves handmade items as much as we do. Within this framework, our company, operating under the trade name Agorart, based in Ilioupoli, Attica, at 42 Athinodorou Street, Postal Code 163 46 [VAT number 159739105] (“Agorart”), has created this online store (hereinafter “e-shop” or the “online store” or “Agorart”) with the purpose of promoting products from creators across Greece to any interested party throughout Greece.

These terms apply to purchases made through the e-shop, which are intended for retail sales for private use. Therefore, we may apply certain restrictions regarding the number of pieces one can purchase in the same order. In any case, it is possible to purchase products with an issued invoice upon request, subject to any aforementioned restrictions.

The sale of products is made only to natural or legal persons who have full legal capacity (natural persons over 18 years old). Access to and use of the e-shop, account creation, as well as the completion of purchases through the e-shop are governed by these Terms and Conditions, as well as the Privacy Policy and Cookie Policy, which relate to the processing of your personal data. These texts collectively concern the operation of our e-shop and constitute a unified set that you will be asked to read and accept when you create an account on our e-shop as well as each time you make a purchase.

Please read these Terms carefully, as their content constitutes the agreement between us for your use of the e-shop, as well as the binding sales contract between us once you place an order on our online store. For any questions regarding the Terms and Conditions, please contact info@agorart.gr.


1. User Account

Purchase as Guest: Logging into the e-shop with a user account is optional. You can make purchases as a guest user.

Creation: By creating an account on our e-shop, you can easily and quickly locate your previous orders, save your shipping and billing addresses for easier reuse, and store your payment methods so you don’t need to enter them each time you place an order.

To create an account, go to the top right side of the e-shop (Login) and select "Create Account". By entering your email, you request the creation of an account. Then, we will send you a unique code to your email, which you will be asked to enter to complete the account creation. Each time you want to log in, we will send a unique code to your email for you to enter. The use of this code authenticates you. Therefore, you must keep it secret and secure to protect your account from unauthorized access and use.

You can also create a user account during the order submission process following the same procedure.

Accuracy of Information: The information you provide in the e-shop forms, either for registering a user account or purchasing as a guest user and/or for product delivery, must be true, accurate, and up-to-date, and you guarantee that Agorart lawfully obtains this information. If you have created an account on our e-shop, you can modify, update, or correct your details anytime by accessing your account (Profile).


2. Account Deletion

You can deactivate your account at any time by sending a related deletion request email to info@agorart.gr. After deleting your account, your data will be removed from our database, while data related to your previous orders, which must be retained for other legal reasons, will be anonymized or pseudonymized. We also reserve the right to delete your account for any reason, following notification to you (e.g., if you violate any of these terms or show bad faith or illegal behavior in order execution). Deletion of the account by any party constitutes termination of the agreement between us, which will cease to apply thereafter.

3. Ordering Products and Completing Purchase

Product Selection: When you enter our online store, you can select the product you are interested in by browsing the relevant category. By clicking on the product you are interested in, you can view photos of the product along with its description, as provided by the product supplier. You can also search for products within the e-shop using the search button located at the top right.

Shopping Cart: You have the option to add the products you wish to purchase to your shopping cart by clicking the “Add to Cart” button. You can view the contents of your cart by clicking the corresponding button at the top right of the screen. In your cart, you will see details about the selected products and be informed about their cost, the total cost of your order, as well as the shipping cost (after entering your country and postal code in the relevant fields at the bottom of the product list). You can modify the contents of your cart until you complete your order.

When filling in your details, you will be asked to:

  • Enter the recipient's full name, shipping address, phone number, and any comments related to the shipment. You can save your details so that they will be pre-filled next time you visit our store by selecting the relevant option. If you place your order while logged into your account, these details will appear pre-filled. You can always choose a different shipping address.

  • Enter your billing details (not financial data) if different from the shipping address (by selecting: “Use a different billing address”).

  • Select your preferred shipping method.

  • Select the payment method (entering the card details you wish to use).

  • Enter any discount code you may have.

Order Submission: After completing your payment and accepting these Terms & Conditions, you submit your order to our e-shop.

Legal Notice: This website does not constitute a contract offer to the buyer, but rather an invitation to submit an offer (by the buyer) to conclude a contract.
By submitting the order, you submit an offer to Agorart for the purchase contract regarding the products you have selected.
Subsequently, Agorart will send you an automated email confirming receipt of your offer to conclude the purchase contract between us. At this stage, we reserve the right to review the execution of your order to verify product availability and pricing (even for products shown as available in the e-shop). This email does not constitute proof of contract conclusion.

If it is confirmed that the products shown as available in our e-shop are indeed available under the terms stated in your order, a confirmation email will be sent to you when your order is ready for shipment to you (which will constitute confirmation of the purchase contract conclusion).

If it is found that a product, although shown as available in our e-shop, is not available under the terms of your order, Agorart will contact you via email and/or phone to inform you.
If a change in your order is agreed upon, a new confirmation email will be sent to you with the updated terms once your order is ready for shipment (constituting contract confirmation).

If, for any reason, we need to cancel your order, you will be informed in writing via email.

Products shown as unavailable in the e-shop cannot be added to your order.

In all above cases, any amount reserved or prepaid (if you used a credit card or similar payment method) constitutes a financial guarantee, not payment of the price, which will be completed only upon confirmation of product availability and price and contract conclusion as stated above; otherwise, the amount will be refunded to you.

Prices on the e-shop are in euros (€) and include VAT. Prices do not include additional shipping costs, which will be informed at checkout based on delivery method and location. Agorart reserves the right to adjust product prices and offers at any time by updating the e-shop.

Price Verification Reservation: Agorart takes all necessary measures for correct price display, but technical errors may occur. Orders are accepted subject to price verification. If you notice an obvious pricing error (e.g., a discount exceeding 70%, abnormally low price, etc.), please notify us immediately and refrain from purchasing that product. Please be especially cautious during sales periods like Black Friday.


4. Shipping and Delivery of Products

Delivery is only made within Greece via a third-party courier company cooperating with us. Delivery time depends on the shipping address and product availability.

Courier Companies:

  • For Attica and all Greece: Geniki Taxydromiki delivers shipments within 2-4 working days from the day the courier collects the package. The estimated delivery time applies to products with confirmed availability, for which we have sent you a confirmation and shipment email. It is calculated from the time we hand over the products to the courier. You can track your shipment by entering the tracking details in the courier’s link provided in the confirmation email.

  • For products “available on order,” a specific delivery time and cost will be agreed based on supplier availability.

Shipping costs are borne by you unless Agorart announces free shipping for orders above a certain amount. Additional costs (e.g., cash on delivery fees) will be communicated to you.

Products can be received by you personally or an authorized person or recipient you designate (e.g., as a gift). Delivery to a person who appears at the shipping address you provided fulfills our delivery obligation.

If you do not collect your order within 3 days of notification by the courier and the order is returned to us, reshipping costs will be charged to you.

From the moment the product is handed to the courier, the delivery timeline is governed by the courier company and Agorart bears no responsibility for delays due to courier issues or force majeure.


5. Payment Methods

  • Credit, debit, or prepaid cards (Visa, Mastercard, Maestro, Diners, Discover):
    If you choose card payment, after entering your card details on Agorart’s platform, you will be redirected to the secure payment environment of our payment provider to complete your transaction and finalize payment. Our e-shop accepts all cards.

  • Via viva.com

Payment via viva.com
If you choose payment through viva.com, you need to click the "Pay Now" button. Then you will be redirected to the "30+ payment methods via Viva.com" page to complete your purchase using one of the available payment methods offered by viva.com.

Legal Notice:
In both cases above, the transaction completion is carried out through a recognized banking institution that declares it provides all the security guarantees for completing electronic payments. We inform you that the e-shop does not process your payment details, and your data are collected directly and only by the banking institution we cooperate with for payment execution. If we are informed by the banking institution that there is a problem with your card details, we reserve the right to reject the order or withdraw from the sale at any time. You are solely responsible for correctly entering your card details.


Bank Transfer
If you choose payment by bank transfer, you will receive an email with the account details (IBAN) where you can make the deposit. The deposit must be made within 2 days from the order submission date; otherwise, your order will be canceled. Your order is considered placed on the date the deposit is made to the indicated bank account.

6. Withdrawal
As a consumer, you have the right to exercise the right of (unconditional) withdrawal as per law 2251/1994, a special right applicable to distance sales.

According to current legislation, a consumer is any natural person acting for reasons not related to their commercial, business, craft, or freelance professional activity. We reserve the right not to accept your withdrawal if you have made purchases with an invoice, as we will consider you are purchasing within your professional activity and thus lack consumer status and the right of withdrawal hereunder.


Conditions for exercising the right of withdrawal:
If you purchase as a consumer, you have the right to withdraw from the sales contract without reason within 14 days from the day the products are delivered to you or a third party you indicated, by making a clear withdrawal statement by:

  • sending a letter by mail or courier to our headquarters,

  • email to info@agorart.gr,

  • filling the withdrawal form found here.

Deadline:
You have 14 days to exercise the right of withdrawal and then another 14 days to return the products. If you send the withdrawal form with the product, both withdrawal and return must be completed within 14 days from the delivery date. The return shipping costs and responsibility are yours. According to law, the proof of exercising withdrawal and returning the product to our headquarters lies with you. For contracts involving multiple products ordered together but delivered separately, the 14-day period starts when you or a third party (other than the carrier) designated by you acquires physical possession of the last product.

If you return a product, it must be in the condition you received it. Additionally, to accept the return, the purchase receipt (receipt or invoice) must accompany the product.

Attention:
You should handle each product as if you were inspecting it in a physical store to check its nature, features, and operation, without using it beyond that. Therefore, the product you return must:

  • if opened, be in intact original packaging, including box, wrapping paper, bubble wrap, etc., without tears,

  • be complete with all accessories and integral components in original packaging,

  • be accompanied by all supporting documents (purchase receipt, instructions, etc.).

Please note that for hygiene reasons, we do not accept returns of the following products: [jewelry].

If you legally withdraw, our company will refund all the money you paid, including shipping costs (except additional costs due to your choices such as cash on delivery), for returned products without undue delay after receiving them. If multiple products are returned, the refund will relate only to the returned product(s) following the above procedure and conditions.

Refunds will be made either to your card through the banking institution (if paid by card) or to the bank account you specify (if paid by any other payment method). For this reason, you must fill in your bank account IBAN in the withdrawal form for the refund transfer. You bear responsibility for the accuracy of your bank details, and the company is not responsible for errors in the IBAN provided.

We reserve the right to delay refunds until we receive the product or proof of its return, whichever occurs first. We also reserve the right to assess the product's condition and refund a reduced amount if the product’s value has diminished due to use. This legal right to offset is a contractual foundation of the sales agreement.


7. Liability from Sale
Our company strives to deliver products with all properties listed on our e-shop and without defects. If you receive a defective product or encounter any problem, contact us at info@agorart.gr to exercise your rights or get information about your product.

If it is found that the product does not comply with the contract (defective or missing agreed properties) within the legal timeframe (currently 2 years from delivery), we will arrange repair or replacement unless this is impossible or involves disproportionate effort. You also have the right to request a price reduction or withdraw from the contract, except for minor defects. After one year, the burden of proof lies with you to show the defect existed at delivery.

Agorart does not manufacture products but sources them from creators and sells them to you. Although suppliers provide declarations of product compliance with laws, we do not guarantee products are free from defects. We disclaim liability for manufacturer defects.

Products sold do not carry a commercial warranty from the supplier or our company unless explicitly provided by the supplier, whose terms then apply. We are not responsible for suppliers' compliance with legal warranty obligations.


8. Limitation of Company Liability
Disclaimers for damages and delays: Agorart is responsible for fulfilling the sale as described in this contract and relevant laws protecting consumers and sales contracts. We are not liable for direct, indirect, special, incidental, consequential damages, lost profits, or harm to reputation or goodwill, or costs of substitute products or services from the use or inability to use the e-shop or purchased products.

We are not responsible for refund delays caused by payment providers despite timely instructions. The company does not guarantee uninterrupted, error-free operation of the website, services, or content. We disclaim liability for deviations in photos from actual products.

By law, we will inform you about your order's progress via the email or phone you provided. Communication is valid even if not received due to errors in your contact info or technical failures outside our control. We bear no liability for delayed or improper fulfillment due to these issues.

We reserve the right to refuse sales due to reasons such as prior bad faith or illegal behavior.


Technical issues:
We strive to provide high technical service levels but are not liable for service interruptions, access difficulties, or damage from malware or cyberattacks. Users access and use the e-shop at their own risk and expense. We disclaim responsibility for technical or network failures beyond our control or force majeure events.

The company assumes no obligations or warranties not expressly made herein or mandated by law. We disclaim liability for indirect, consequential damages or lost profits from using the site, content, or inability to purchase or receive items.

In case of proven fault by the company, liability is limited to actual damages.

10. Validity of Terms and Conditions and Their Modification
Please read these Terms and Conditions carefully before any visit, use of the website, account creation, or completion of purchases through the Company’s e-shop or by phone order. Any use of this e-shop implies and constitutes your unconditional acceptance of all texts contained in the e-shop’s Terms and Conditions. These Terms and Conditions, as well as any modifications to them, which you will be notified of via the e-shop, constitute the contract between us at any given time. Also applicable are specific terms, offers, and special arrangements announced from time to time on our e-shop or sent to you by email or other means of communication. If you disagree or reserve any objections to any part or all of these Terms and Conditions, please refrain from using or accessing the e-shop; otherwise, your acceptance is presumed unconditional.

Please visit this website regularly to stay informed about any changes to the Terms and Conditions, especially before placing any order. We reserve the right to:

  • modify at any time, without reason and without prior notice to the visitor, part or all of these terms of use, which will be effective from their posting on our website;

  • renew or upgrade part or all of the Website content;

  • renew or upgrade part or all of the Website’s external appearance (interface), structure, configuration, or technical specifications;

  • restrict access to the entire Website or parts of it and/or to your account.

Additionally, the Company reserves the right, at any time, without reason and without prior notice to the visitor, to cancel, suspend temporarily or permanently, or terminate the operation of the Website. Access to this Website is allowed only under these terms and conditions. It is emphasized that the Company reserves the right to modify the products offered for sale, to permanently or temporarily cease the sale of some or all products from specific or all suppliers without prior user notification.


11. Dispute Resolution and Applicable Law
The drafting and interpretation of these Terms and Conditions are governed by Greek law. By accepting these terms, you agree to submit to the exclusive jurisdiction of the courts of Athens.

You have the option to choose electronic dispute resolution for any disputes arising from our contract for the provision of services, by following the Alternative Dispute Resolution (ADR) procedure concerning consumer disputes within the European Union. This is available via the online dispute resolution platform (ODR platform) at https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home2.show&lng=EL, which allows consumers and suppliers to submit disputes arising from online purchases to an online resolution process.

A necessary prerequisite for the consumer to apply to the ADR procedure is to have first notified our Company by email at info@agorart.gr seeking a resolution. The ADR procedure is, by law, non-binding for the parties, who may withdraw at any time. The consumer may contact the ADR body above for guidance throughout the complaint submission and handling process.
